This Terms and Conditions of Use, and Privacy Policy (TCUPP) discloses the terms, use, and privacy practices for engaging in programs and/or services which include all in person and virtual (digital, electronic, telephonic, video) activities and communications of the Black Child Development Institute – New York State.
This TCUPP applies to information collected by and use of our web site or other digital, telephonic, or electronic media and during participation in our programs, services, or other engagement you may have with us including in-person and virtual engagement. It will notify you of the following:

We are the sole owners of the information collected on our website or that we collect in virtual spaces, at our programs, and when conducting services, except in cases where information is linked to websites owned or controlled by others or where information is collected by others. We only have access to/collect information that you voluntarily give us via email or other electronic, digital, telephonic, or video media, or via direct contact from you, and will not share it, except, however, in the case of our business partners including but not limited to digital media service providers that manage, host or assist in the management or hosting of our website or other digital spaces, or program and service partners, consultants, agents, or contractors who need access to the information to carry out programming, service, or operational activities. We will not sell or rent this information to anyone.
We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, deliver services and programs to you that you requested for yourself or on behalf of people you are authorized to represent, to maintain and/or manage our website or other digital media, and/or as required by law. We may share aggregated demographic information with our partners and advertisers, if any. This is not linked to any personal information that can identify any individual person.
We may use an outside company to carry out our operations including but not limited to an online payment processing company and/or a credit card processing company to process payments and bill users for goods and services. We do not have access or control over the information you provide to the online payment processing companies. These companies have their own privacy policies that you should review whenever possible. These companies should not retain, share, store or use personally identifiable information for any secondary purposes beyond filling your order without your consent, however, Black Child Development Institute – New York State does not control or warrant and has no responsibility in any case. We will share names or other contact information that is necessary for the third party to provide these programs or services. We do not authorize these parties to use personally identifiable information except for the purpose of providing these programs or services.
Unless you ask us not to, we may contact you via email, text, social media, postal mail, or phone in the future to tell you about opportunities, events, programs, services or other information such as invitations, reminders, solicitations, or changes to this privacy policy. Security

WAIVER, RELEASE, HOLD HARMLESS, AND INDEMNIFICATION
In addition to the circumstances in the above paragraphs, by participating in Black Child Development Institute – New York State programs or services, and those of our partners or agents, whether such participation is in person or virtual (digital, electronic, telephone, video), and/or using our or our partners' or agents’ property or resources, you acknowledge that you are aware of, appreciate the character and nature of, and voluntarily assume the risks involved in participating in any and all activities associated with such programs or services, which include but are not limited to rallies, trips, social media use, internet use, conferences, celebrations, workshops, and other events and activities. As consideration for being permitted to participate in Black Child Development Institute – New York State programs, services, and/or use its property or resources you understand and accept that you waive any claim or cause of action against and release from liability Black Child Development Institute – New York State including our directors, officers, employees, volunteers, partners, and agents for any liability for injuries to you, your child, ward, or client or your, your child's, ward's, or client's property resulting from your participation. You agree to indemnify and hold harmless Black Child Development Institute – New York State, including its directors, officers, employees, volunteers, partners, and agents for any claims, causes of action, or liability to any other person arising from your participation in activities associated with Black Child Development Institute – New York State programs, services, and/or use of our property or resources or those of our agents or partners. Further, you and, on behalf of your child, ward, or client acknowledge and understand that there are known and unknown risks of injury, damage, or harm associated with participation in any and all activity associated with Black Child Development Institute – New York State programs, services, and/or use of our property or resources or those of our partners or agents and you accept those risks. You, and, on behalf of your child, ward, or client willingly assume the risks associated with participation and accept that there are also risks that may arise due to other participants which you also willingly assume. Further, you consent to receive, or for your child, ward, or client to receive, any medical treatment deemed advisable in the event of injury, accident, or illness during these activities. You, on behalf of yourself, your child, ward, or client, your spouse, heirs, assigned representatives and next of kin, agree to hold harmless, release, waive, and indemnify Black Child Development Institute – New York State including its directors, officers, volunteers, partners, and agents, and other associated entities, our predecessors, and successors for any defense cost or expense arising from any and all claims, causes of action, injuries, liabilities, or damages arising from participation in our programs, services and/or use of our property or resources, including any claim that may arise due to negligence or gross negligence on our part. You agree to participate in programs, services, and any associated activities of Black Child Development Institute – New York State in a safe and respectful manner and to observing all applicable laws. You agree to follow all applicable laws when using Black Child Development Institute - New York State property or resources or those of their partners or agents. You understand and agree that if you, or your child, ward, or client, refuse to cooperate or comply with the instruction of Black Child Development Institute – New York State duly authorized staff, whether paid or volunteer, you or your child, ward, or client may be required to end participation immediately and be barred from future participation in Black Child Development Institute – New York State programs, services, and/or use of our property or resources.
Validity and Enforcement
If any provision of this TCUPP is found to be invalid or unenforceable, the validity or enforceability of any other provision of this TCUPP will not be affected and the other provision(s) shall remain in full force and effect.
